5-Year-Old Sexually Assaulted in Gender-Neutral Bathroom, Dept. of Ed Investigates

A 5-year-old girl was sexually assaulted by a boy in her Decatur school’s bathroom after the school district passed a gender-neutral policy allowing students to freely use the bathroom of their choosing.

The Decatur School District has denied the allegations and retaliated against the girl’s mother for reporting by identifying her as the “responsible party” in their referral of the incident to the Georgia Division of Family and Children Services.

In May of 2016 under the Obama Administration, the Departments of Justice and Education’s respective civil rights division’s “Dear Colleague” letter to schools about transgender students said that no students would be asked to prove or otherwise document their gender identity, and adherence to Title IX is “a condition of receiving federal funds.” In other words, comply with the new guidance or your school will lose money.

President Trump’s Department of Education, headed by Betsy DeVos, has stepped in to investigate whether the school district’s transgender bathroom policy lead to the sexual assault.
